EB5 Full Investment program

Qualifying Criteria: 

The EB-5 program is a pathway for foreign national investors to permanently live in the US by making a qualifying capital investment in the US. To qualify for a Green Card through EB-5 you must:


  • Be at least 21 years old
  • Show that you have legal sources of funds and assets
  • Be eligible for a Green Card based on your qualifying capital investment


1– Creation of a new U.S. enterprise

You must invest at least US$1 million in a new commercial enterprise or US$500,000 if the enterprise is located in a targeted commercial area (including areas with unemployment that is 50% of the national average or rural areas). The capital investment may be in the form of cash, inventory, equipment or other tangible assets or cash equivalents that are easily convertible.

The enterprise must create at least ten full-time jobs for qualified US workers, who must be directly employed by the enterprise. The investor is required to actively manage the enterprise.

2. Invest in a regional center

  • Make an investment of US$500,000
  • The new enterprise must create full-time employment for at least ten qualified US workers, although indirect employment is allowed
  • Active management is not required


Overview of the physical Project:

The project is a twelve story mixed-use multi-tenant commercial building (approximately 330,000 sq. ft. of which 317,000 sq. ft. is rentable) with an adjacent parking deck that has some 600 parking spaces. As of October 15, 2015 the project is 70% completed and has 90% lease rate with full completion by June 2016.

The first four floors of the building are occupied by the Westin Hotel that has 119 rooms. The remaining floors occupied by office tenants. As of October 26, 2015 the first two tenants, DN and KeyBank, have already moved in.

EB5 Timeline, Process and Conditions:

  • Investment in Project
  • Getting your CGC (Conditional Green Card) After 18 months
  • Keep it for 2 years (90 days prior to expiry apply for Green Card)
  • Keep it for 3 more years
  • Then apply for Citizenship
      • Transfer your US$500K investment plus into the escrow account of the regional center
      • Submit the completely accomplished I-526 (Petition for Alien Entrepreneur) to show that you are compliant with the program requirements. It has to be approved by the USCIS before you receive your Green Card.
      • USCIS (United States Citizenship & immigration services) Authority has to approve it.
      • You will be issued a Conditional Green Card that is valid for two years and granted Conditional Lawful Permanent Residence (CLPR) status, which is extended to the investor, his spouse and qualified children.
      • You have to file for removal of the conditional status during the 90 days immediately preceding the second anniversary of CLPR status. To qualify for removal, you have to demonstrate full investment as well as compliance with the job creation requirement. An Unconditional Green Card is valid for ten years and you may apply for citizenship three years after issuance.
      • All Green Card holders must remain in the US for longer than six months out of every year
      • Permanent residents are not allowed the privileges of citizenship, such as being allowed to vote
      • Unconditional Green Cards are good for ten years.
      • The difference between permanent residency and citizenship is that you cannot vote, you are still subjected to tax.
      • Approval of an AOS application or the grant of an EB-5 visa followed by entry into the U.S. in EB-5 status means that the investor and the spouse and qualified children of the investor have been granted Conditional Lawful Permanent Residence (CLPR) for two years.



    • Transfer your US$500K investment plus into the escrow account of the regional center
    • Have lived within the state, or USCIS district with jurisdiction over your place of residence, for at least three months prior to the application;
    • Have continuous residence in the U.S. as a Green Card holder for at least five years immediately preceding the application;
    • Be physically present in the U.S. for at least 30 months out of the five years (60 months) immediately preceding the application
    • Reside continuously within the U.S. from the date of application for naturalization up to the time of naturalization;
    • Read & write English
    • Be a person of good moral character
